These Terms of Service ("Terms") govern your access to and use of our AI growth infrastructure services, including but not limited to consulting, software, and automation solutions (the "Services"). By using our services, you agree to comply with these terms.
By accessing or using our services, you confirm that you have read, understood, and agreed to be bound by these terms. If you do not agree, you may not use our services.
Our services include AI-driven growth solutions, consulting, automation tools, and related infrastructure support. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.
You must be at least 18 years old to use our services. By agreeing to these terms, you represent that you have the legal capacity to enter into a binding contract.
Fees for our services are outlined in your contract or service agreement. Payments must be made in full and on time to avoid service disruptions. We reserve the right to modify pricing, and any changes will be communicated in advance.
All intellectual property related to our services, including software, designs, and methodologies, remains the sole property of BlueWaveAi, C&J Legacy Capital LLC, or its licensors. Clients receive a limited, non-exclusive, and non-transferable license to use our solutions as per their contract.
You agree to use our services only for lawful purposes. Do not attempt to reverse engineer, modify, or resell our technology without authorization. Respect our proprietary rights and confidentiality agreements.
Both parties agree to maintain the confidentiality of proprietary and sensitive information exchanged during the course of business. Disclosure of confidential information without written consent is prohibited.
At BlueWaveAI, we are committed to delivering 10+ estimate-ready appointments (design consultations or estimates) within 90 days through our AI-powered lead generation system. We stand behind our service with a performance guarantee, detailed as follows:
1. Payment Structure
A one-time setup fee is required upfront to launch the system, covering onboarding, ad creation, CRM setup, and automations. The first 30 days of the monthly retainer are free. The first monthly retainer payment will be billed on Day 31 after onboarding.
2. Performance Guarantee
If the client meets all responsibilities (see below) and we do not deliver at least 10 estimate-ready appointments within 90 days, the client may request a full refund of the previous monthly retainer payment. The setup fee is non-refundable.
3. Client Responsibilities
To qualify for this guarantee, the client must ✔ follow all strategic recommendations, including lead handling processes, follow-up workflows, and ad spend requirements. ✔ Provide all required assets and access in a timely manner (e.g., business info, ad approvals, CRM/calendar access). ✔ Respond promptly to leads and maintain communication throughout the 60-day period.
4. Definition and Tracking of Appointments
✔ An “appointment” is defined as a scheduled estimate or design consultation with a qualified homeowner interested in pool services. ✔ Appointments will be tracked through calendar integrations, CRM records, call logs, or lead activity reports.
5. Refund Eligibility ✔
If the guarantee is not met by Day 90 and the client has complied with all responsibilities, the client may request a full refund of the monthly retainer payment billed on the first of the previous month. ✔ The setup fee is non-refundable under any circumstances due to the upfront labor and resources allocated.
6. Exclusions to Guarantee
The performance guarantee is void if❌ the client fails to implement strategies or delays required approvals. ❌ The client does not respond to leads or fails to attend booked appointments. ❌ The client declines qualified leads based on non-business-related preferences. ❌ The client does not provide an adequate ad budget, tools, or resources as agreed. ❌ External events (e.g., economic downturns, platform bans, or technical limitations) significantly impact performance.
We reserve the right to determine refund eligibility based on adherence to the above terms and documented campaign performance.
Our Services are provided "as is" without any warranties, express or implied. While we strive for results, we do not guarantee specific outcomes beyond the scope of our defined performance guarantee. We shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services.
We reserve the right to terminate or suspend your access to our services if you violate these terms. Upon termination, you must cease all use of our services.
These Terms shall be governed by and interpreted in accordance with the laws of the State of Arizona, United States. Any disputes arising under these Terms shall be resolved through arbitration or litigation in the appropriate courts located in Arizona.
We may update these terms from time to time. Continued use of our services after changes constitutes acceptance of the new terms.
